1. Parties and Acceptance of Terms

These Terms and Conditions of Sale ('Terms') constitute a binding agreement between KwaNyanga Online, operated by [Your Registered Business Name] ('KwaNyanga', 'we', 'us', 'our'), and any person who browses, places an order on, or purchases from our online store at kwanyangaonline.co.za or via WhatsApp ('you', 'the customer', 'the consumer').

By placing an order with KwaNyanga Online, whether through the website, WhatsApp, Instagram or any other channel, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree to these Terms, you must not place an order.

 

These Terms are governed by and must be read in conjunction with the Consumer Protection Act 68 of 2008 ('CPA'), the Electronic Communications and Transactions Act 25 of 2002 ('ECTA'), and the Protection of Personal Information Act 4 of 2013 ('POPIA'). Where any provision of these Terms conflicts with applicable legislation, the legislation prevails.

3. Products and Descriptions

KwaNyanga Online sells authentic ancestral and traditional spiritual supplies including amabhayi (ancestral cloths), amabhule (beads), intelezi (ritual bath salts), izibane (candles), izimpunzi (duiker horns), and custom beadwork. All products are described as accurately as possible on our website and via WhatsApp communications.

 

You acknowledge and agree that:

     Slight variations in colour, shade or pattern between product photographs and the actual item may occur due to screen display settings, batch differences in handcrafted goods, and the natural variation of traditionally manufactured materials. Such variations do not constitute a defect.

     Product images are representative. Where a product is offered in multiple colours or variants, the image shown may depict only one option.

     Descriptions of the spiritual, ceremonial or ancestral significance of products are provided for cultural information purposes only and do not constitute a warranty, guarantee or professional spiritual advice of any kind.

     Custom and made-to-order items are produced according to the specifications agreed between you and KwaNyanga Online in writing via WhatsApp or other communication channels at the time of order.

 

4. Placing an Order

4.1 How to Order

Orders may be placed through the following channels:

     Online via the Shopify store at kwanyangaonline.co.za

     Via WhatsApp at +27 75 062 8490

An order is only confirmed once you have received written confirmation from KwaNyanga Online (via order confirmation email, WhatsApp message or similar) and payment has been received and verified.

 

4.2 Cooling-Off Period (Section 44 ECTA)

In accordance with Section 44 of the Electronic Communications and Transactions Act, if you are a consumer and you purchased goods through our website (an electronic transaction), you have the right to cancel the transaction without reason or penalty within seven (7) days of receiving the goods, subject to the following exceptions:

     Goods that have been opened, used or that cannot be returned for hygiene reasons (including opened bath salts and candles).

     Custom or made-to-order items produced to your specific instructions.

     Goods whose price is subject to fluctuations in the financial market that cannot be controlled by KwaNyanga Online.

 

To exercise your cooling-off right, notify us in writing via WhatsApp within seven (7) days of delivery. You are responsible for the cost of returning the goods and the goods must be returned in their original, unused condition. A full refund of the purchase price will be processed within thirty (30) days of receiving the returned goods.

 

4.3 Right to Refuse or Cancel Orders

KwaNyanga Online reserves the right to cancel or refuse any order where:

     A product is out of stock or discontinued.

     A pricing error has occurred on the website.

     Payment cannot be verified.

     We reasonably suspect fraudulent activity.

In the event that we cancel your order after payment, a full refund will be processed within five (5) business days.

 

5. Pricing and Payment

5.1 Prices

All prices are displayed in South African Rand (ZAR) and are inclusive of VAT where applicable. Prices are correct at the time of display but may be subject to change without prior notice. The price applicable to your order is the price confirmed at the time of order confirmation.

Delivery charges are in addition to the product price and are displayed at checkout. Free delivery is offered on orders over R750.00.

 

5.2 Payment Methods

KwaNyanga Online accepts the following payment methods:

     Credit and debit card (Visa and Mastercard) via PayFast

     Instant EFT via PayFast

     SnapScan

     Payflex (buy now, pay later in four instalments)

     Manual EFT (for WhatsApp orders — payment reference required)

 

Payment must be received and confirmed before an order is dispatched. For manual EFT orders, goods will only be shipped once the payment reflects in our account.

 

5.3 Pricing Errors

In the event of an obvious pricing error (for example, a product listed at R0.00 or at a price clearly inconsistent with its market value), KwaNyanga Online reserves the right to cancel the order and refund any payment received. We will notify you promptly and offer you the opportunity to re-purchase at the correct price.

 

6. Delivery

6.1 Delivery Areas

KwaNyanga Online delivers to all nine provinces of South Africa via registered courier services. We do not currently offer international shipping.

 

6.2 Delivery Timeframes

Estimated delivery timeframes are as follows:

     Gauteng and KwaZulu-Natal: 2 to 3 business days.

     Other provinces: 3 to 5 business days.

     Remote or rural areas: 5 to 7 business days.

 

These are estimates only and are not guaranteed. KwaNyanga Online is not liable for delays caused by the courier, public holidays, extreme weather, industrial action or other circumstances beyond our control.

 

6.3 Delivery Charges

A flat-rate delivery fee applies to orders below R750.00. Free delivery is offered on all orders of R750.00 or more. The applicable delivery charge will be confirmed at checkout or in your WhatsApp order confirmation.

 

6.4 Risk and Ownership

Risk in the goods passes to you upon delivery to the address provided at checkout. Ownership of the goods passes to you only once full payment has been received and confirmed by KwaNyanga Online.

 

6.5 Failed Deliveries

If a delivery attempt fails because no one is available at the delivery address, the courier will make a second attempt or hold the parcel at a collection point. You are responsible for ensuring that someone is available to receive the delivery at the address provided. Redelivery fees may apply.

 

7. Returns, Refunds and Exchanges

Our Returns, Refunds and Exchanges Policy forms part of these Terms and is incorporated herein by reference. Please read it carefully at kwanyangaonline.co.za/policies/refund-policy. Your statutory rights under the Consumer Protection Act 68 of 2008 are not affected by these Terms.

 

8. Intellectual Property

All content on the KwaNyanga Online website and social media platforms — including but not limited to product photographs, descriptions, the KwaNyanga logo, branding, written content and graphic designs — is the intellectual property of KwaNyanga Online or is used with permission. All rights are reserved.

You may not reproduce, copy, distribute, publish, modify or use any of our content for commercial purposes without our prior written consent. You may share our content on social media platforms for non-commercial purposes provided that KwaNyanga Online is clearly credited.

 

9. Privacy and Protection of Personal Information

KwaNyanga Online processes your personal information in accordance with the Protection of Personal Information Act 4 of 2013 ('POPIA'). By placing an order, you consent to the collection and processing of your personal information for the purposes of fulfilling your order, communicating with you about your purchase, and sending you marketing communications where you have opted in.

The personal information we collect includes your name, delivery address, contact number, email address and payment information. We do not sell or share your personal information with third parties except where necessary to fulfil your order (for example, sharing your delivery address with our courier partner).

 

You have the right to:

     Access the personal information we hold about you.

     Request correction of inaccurate information.

     Object to the processing of your information for direct marketing purposes.

     Lodge a complaint with the Information Regulator at www.inforegulator.org.za.

10. Limitation of Liability

To the maximum extent permitted by applicable law (including the Consumer Protection Act), KwaNyanga Online's liability to you for any claim arising from the purchase of our products is limited to the purchase price paid for the specific product giving rise to the claim.

KwaNyanga Online is not liable for:

     Indirect, consequential or incidental loss or damage of any kind arising from the use of our products.

     Any spiritual, ceremonial or personal outcome associated with the use of our products. Products are sold as material goods only, and no warranty or guarantee is made regarding any spiritual efficacy or outcome.

     Losses arising from delivery delays caused by third-party courier services.

     Any loss arising from your reliance on product descriptions for purposes other than the purchase of the product as a material good.

 

Nothing in this clause excludes or limits any liability that cannot lawfully be excluded or limited under the Consumer Protection Act 68 of 2008 or any other applicable South African law.

 

11. Prohibited Conduct

When interacting with KwaNyanga Online, you agree that you will not:

     Provide false, misleading or fraudulent information in connection with any order.

     Use our products, website or social media platforms for any unlawful purpose.

     Infringe any intellectual property rights belonging to KwaNyanga Online.

     Engage in abusive, threatening or harassing conduct toward KwaNyanga Online staff or representatives.

     Attempt to fraudulently reverse or chargeback a legitimate transaction.

 

KwaNyanga Online reserves the right to refuse service to any person who engages in prohibited conduct.

 

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from or relating to these Terms or any transaction concluded with KwaNyanga Online shall be subject to the jurisdiction of the South African courts, and the parties consent to the jurisdiction of the Magistrates' Court having jurisdiction over the dispute, without prejudice to the right of either party to approach a High Court.

 

Consumers also have the right to refer disputes to the National Consumer Commission (www.thencc.org.za) or the Consumer Goods and Services Ombud (www.cgso.org.za) before or instead of approaching a court.

 

13. Amendments to These Terms

KwaNyanga Online reserves the right to amend these Terms at any time. The updated Terms will be published on our website with a revised effective date. Your continued use of our website or placement of an order after any amendment constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

 

14. General Provisions

     If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be severed and the remaining Terms will continue in full force and effect.

     Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

     These Terms, together with the Returns and Refunds Policy and any written order confirmation, constitute the entire agreement between you and KwaNyanga Online in relation to the purchase of our products.

     These Terms supersede any prior agreements, representations or warranties, whether written or oral, relating to the subject matter hereof.
